01 About these terms
These terms describe the conditions for using AdPopz’s advertising platform and related services. “AdPopz”, “we”, “us” and “our” refer to the service operating under the AdPopz brand. Read these terms together with our Privacy Policy and Refund Policy before creating an account or purchasing services.
02 Eligibility and account responsibility
Our services are available to legitimate individuals and businesses worldwide, subject to applicable laws and service availability. You must have the legal capacity to enter into an agreement and authority to act for any business you represent. Provide accurate account and application information, keep login details secure, and notify us if you suspect unauthorized access.
Applications and advertising materials may be reviewed before access or delivery is approved. Submission does not guarantee approval. We aim to respond to applications within 24 hours.
03 Advertising content and lawful use
We do not advertise or promote illegal products, services or activities. Your campaigns, creatives, destination pages, targeting and use of customer data must comply with applicable laws in the markets you target. You are responsible for the accuracy of your claims and for holding the permissions, licences and intellectual property rights needed for your advertising.
Do not submit fraudulent or misleading content, distribute malware, infringe others’ rights, or interfere with the platform’s security. We may refuse or pause a campaign when necessary to investigate suspected unlawful activity or policy violations. Approval of an advertisement is not a legal endorsement of its content.
04 Plans and campaign management
FISH is a self-serve plan: you manage your own campaigns. SHARK offers hybrid management with setup support and monthly optimization. WHALE offers full campaign management and weekly optimization. The features, fees, minimum advertising spend and markups shown for your selected plan at purchase form part of your agreement.
You remain responsible for approving your offer and advertising materials and providing the access and information needed to deliver the service.
05 Prices, funding and recurring billing
Prices are stated in US dollars (USD). Paid plans renew automatically each month on your monthly billing date until cancelled. Any applicable taxes and additional charges must be disclosed before payment.
Advertising funds are separate from plan fees and are deposited into your AdPopz account. The FISH plan has no monthly platform fee, but advertising spend and its applicable markup still apply. Review your plan’s minimum spend and markup before funding or launching campaigns.
06 Cancellation and refunds
You may cancel your paid plan at any time. Cancellation prevents the next monthly renewal; service continues until the end of the billing period already paid for. To request cancellation, contact us using the details below and identify your account.
Service fees are nonrefundable, subject to mandatory legal rights. Goodwill compensation may be considered case by case. Campaign funds are eligible for a full refund if the campaign is cancelled before traffic delivery starts. Once traffic delivery has started, that campaign’s funds are nonrefundable. 07 Performance and availability
Advertising results depend on factors such as your offer, creative, audience, budget and destination page. We do not guarantee a specific number of sales, leads, conversions or a particular return on investment. Traffic protection helps reduce unwanted traffic but cannot eliminate all invalid traffic.
Formats, inventory and geographic availability may change. Maintenance and third-party network interruptions may affect access or delivery. Contact us promptly if you experience an issue so we can investigate.
08 Content and platform rights
You retain ownership of the advertising materials you provide. You authorize AdPopz and the providers involved in campaign delivery to use those materials as needed to run and manage your campaigns. AdPopz branding, website content and platform materials remain protected by their applicable intellectual property rights; using the service does not transfer ownership of them to you.
09 Privacy and communications
Our Privacy Policy explains how personal information is handled. Service-related messages may be needed to administer your account. You can unsubscribe from marketing communications without cancelling your account.
10 Applicable law and your rights
These terms are intended to be governed by the laws of Ontario and the applicable federal laws of Canada, except where mandatory laws in your location provide otherwise. Contact us first with a concern so we can try to resolve it.
Nothing in this policy excludes or limits rights or remedies that cannot lawfully be excluded, including any applicable consumer cancellation or refund rights. Where mandatory law requires a different outcome, that law applies.
11 Changes and contact
We may update these terms as our services change. The revision date will appear on this page. Material changes affecting an existing agreement will be communicated before they take effect where required; changes will not retrospectively remove accrued rights.
